COVENANTS AND BUILDING RESTRICTIONS FOR MUSICA
DEL MAR ESTATES
GENERAL DISPOSITIONS:
These
regulations are for the purpose of conserving the concepts and characteristics
to which they were designed for the owner and residents of Musica del
Mar Estates.
-
Lots
62-12 to 62-18 and 63-13 to 63-24 will have a one level high restrictive
building covenant to a maximum of 16 feet (4.8 meters) plus allowance
for one only patio palapa to a maximum roof height of 21 feet (6.4
meters).
- Lots 62-1 to 62-11and
63-1 to 63-12 will have a two level high restrictive building covenant
plus allowance for a roof top palapa.
- Setbacks:
A - A minimum of 2 meter setback is required for any construction from
the front or back of the property line.
B - A minimum of 1.5 meter setback is required for any construction
from the side of any property line, not including fence
construction.
C - Fence height is restricted to a maximum of 2 meters in height.
D - It is understood that any additions or add-ons to your home such
as sunshades, terraces, balconies, etc. shall conform
to above setbacks.
- No commercial
enterprises or advertising signage will be allowed.
- Only single family
permanent homes with a minimum of 150 square meters of covered living
space are allowed.
- All construction
must conform to local municipal building codes.
- All structures
built must conform to earthquake code.
- All septic tanks
and fields must be underground and built and located to municipal standards
and located within a sufficient distance from the master well to protect
the drinking water for the project.
- All homes must
have a minimum of 2500 litre underground water storage cistern with
pressure reducing valves. No rooftop storage system allowed.
- Fifteen (15) kilowatts
of power will be supplied to the property line of each lot. Any requirements
above that will be the responsibility of the purchaser with all contractual
arrangements with C.F.E. and all additional installations must be underground.
- Home construction
must be started within five (5) years from the date of purchase with
total completion being no later than twelve (12) months from start of
construction. This is to include all finishing and painting of exterior
surfaces including fences and unattached buildings.
- A minimum maintenance
fee of $50.00 USD per month, payable on or before the first of each
month will be required for each lot. The amount will be reviewed upon
the formation of a owners association.
- An owner who has
the use of limited common property (i.e. the beach)
- must clean up after themselves and guests and pets,
- can not cause a nuisance or hazard to another person or property,
- can not cause unreasonable noise,
- can not unreasonabily interfere with the rights of others to enjoy
the common property.
- An owner must repair
and maintain his own structures and lot.
- An owner, guest,
or tenant shall not keep any type of animal other than household pets.
Any pets will not be allowed on common property except on a leash accompanied
by the owner.
- An owner must not
keep or accumulate any debris, scrap metal, vehicle parts, refuse or
waste material upon his/her lot or common property.
- An owner, guest,
or tenant must park all motor vehicles, recreational vehicles, trailers,
boats, etc. within the confines of their own property.
- An owner must carry
out all work and pay all rates, taxes, licences and charges as required
by public and local authority in respect to his/her own lot.
- No road, lights,
fixtures, common services, or common areas may be changed in any way
from the master plan of Musica del Mar Estates.
- All names assigned
to the project, streets, walkways, and roads will adhere to the master
plan.
- No home construction
can be built within 2.0 meters of the services: water, electrical, plumbing,
conduits, etc.
- If any services
to any residence are installed incorrectly or are deemed defective so
as to cause hardship to neighbouring properties or common properties,
all service to this residence will be suspended and will not be renewed
until property repairs are complete.
- The architecture
of homes should be either Mexican traditional, colonial, or contemporary
design indicative of the area, colors, roof tiles, etc.
- All home plans
to be approved by Barra Desarrollo Escenciales S.A. de C.V.
- Single axle vehicles
only to a maximum of 15 tons will be allowed on the property.
- To maintain and
protect the quality of construction and infrastructure of "MUSICA
DEL MAR ESATES", Lujo Grupo Constructor Lujo S.A. de C.V. will
be considered the general contractor in a supervisor capacity if alternative
builders are used. A supervisory fee will be payable to Lujo depending
upon the plan and length of time of construction of the home.
